H owned mobile home parks and, when occupiers wished to move the mobile home was generally sold to H or a third party. The mobile home was usually scrapped and rebuilt. CEC argued that the sale of a mobile home was made up of the taxable supply of the mobile home itself and the exempt supply of the grant of the licence to occupy. CEC contended that the tribunal had erred in law. H argued that the mobile homes were buildings and the provision of the concrete base and pipe work was part of the supply of the home itself.
